TERMS & CONDITIONS
RENTAL AGREEMENT

All Terms and Conditions listed below apply to all agreements entered into by Slumber and Shine and the client. Clients that have paid the deposit or the total cost of their party are agreeing to AND stating that they have read and will adhere by the agreement terms put forth below.


Indemnity
The client shall assume full responsibility for the rented materials and take all necessary precautions to safeguard all individuals and property from harm or damage. The client hereby agrees to indemnify and hold Slumber and Shine free from any and all liability, claims, judgments, attorney fees, and associated costs of any nature, including but not limited to injuries, fatalities, or property damage resulting from the use, maintenance, installation, operation, possession, or ownership of items supplied by Slumber and Shine, regardless of the cause.


Exemption of Liability & Acceptance of Risk
The client acknowledges and fully understands that utilizing the items outlined in the Terms and Conditions/ Rental Agreement carries inherent risks of injury, death, or property damage. By entering into this Agreement voluntarily, the client accepts all the mentioned risks willingly. The client further agrees to absolve Slumber and Shine of any responsibility or liability for such injuries, fatalities, or damage resulting from the use or operation of the rental items. Moreover, the client expressly waives and relinquishes any and all claims related to injuries, fatalities, or property damage against Slumber and Shine, which they may otherwise have been entitled to assert.

 

Effectiveness of Rental Agreement
The Terms and Conditions/ Rental Agreement may be transmitted via email. The agreement remains in effect regardless of whether it is formally signed by the Clien
t. If the client takes possession of the rental items. It is also considered valid when signed by a representative acting on behalf of the Client. In such cases, the representative will sign their own name and include how they are related to the Client for clarification.

 

Reservations/Ownership
Slumber and Shine agrees to reserve all items required for the specific party only once the deposit is made.
The remaining balance of the party must be paid one week prior to the delivery date. If the remaining balance is not paid by one week prior to the delivery date, Slumber and Shine reserves the right to cancel the
reservation without refunding the deposit or discuss rescheduling.

 

The Client is entitled to the use of the rental equipment for one overnight period. The rental agreement concludes upon return of the rental equipment to Slumber and Shine. The Client grants Slumber and Shine authorization to reclaim rental items whether or not the equipment is located in a private residence.

Fulfillment Policy

Slumber and Shine exclusively serve the Santa Clarita area. Service outside of this area requires a prior written agreement. On the reservation date, Slumber and Shine will deliver and set up your products and will return the following day to break down and remove all products and items. Slumber and Shines standard rental period is 24 hours unless otherwise agreed upon in a written agreement. 

Cancellations
The client agrees to pay the specified deposit in order for Slumber and Shine to reserve their party dates. Deposit will be applied to your total of the party. Clients who cancel with at least 10 days' notice will be eligible for a complete refund. If a client cancels with 9 days or less notice, they will have the option to receive a credit equivalent to their deposit, which will be held with Slumber and Shine and can be used for a future booking.

 

Damage to Equipment
The client agrees to be charged and pay the full costs of any items that are damaged, lost or stolen. The client will receive receipts showing the cost of items in the event they need to be replaced.
